Terms & Conditions For Purchase of Templates
Access to and use of this site ('halare.co.uk') is provided by Halare and subject to the following terms:
1. By using halare.co.uk you agree to be legally bound by these terms, which shall take effect immediately on your first use of halare.co.uk. If you do not agree to be legally bound by all the following terms please do not access and/or use halare.co.uk.
2. Halare may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by Halare. Your continued use of halare.co.uk after changes are posted means you agree to be legally bound by these terms as updated and/or amended.
3. You may not copy, reproduce, republish, download, post or otherwise make available to the public the content of halare.co.uk except for your own personal use. Any other use of halare.co.uk content requires the prior written permission of Halare.
4. You agree to use halare.co.uk only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of halare.co.uk. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within halare.co.uk.
5. halare.co.uk content, including the information, names, images, pictures, logos and icons regarding or relating to the Halare, Halare Database Services, Halare Internet Service and/or Halare SMS Services, its products and services (or to third party products and services), is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
6. Under no circumstances will Halare, Halare Database Services, Halare Internet Service and/or Halare SMS Services be liable for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of halare.co.uk regardless of the form of action.
7. Halare does not warrant that functions contained in halare.co.uk content will be uninterrupted or error free, that defects will be corrected, or that halare.co.uk or the server that makes it available are free of viruses or bugs.
8. The names, images and logos identifying Halare, Halare Database Services, Halare Internet Service and/or Halare SMS Services or third parties and their products and services are subject to copyright, design rights and trade marks of the Halare and/or third parties. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of Halare or any other third party.
9. If there is any conflict between these terms and specific terms appearing elsewhere on halare.co.uk then the latter shall prevail.
10. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
11. These terms shall be governed by and interpreted in accordance with the laws of England and Wales.
1. We do not allow Adult, Warez, illegal MP3 Sites or IRC Bots.
2. You may not store more data in your account than your alotted server space.
3. Your server space and ftp account is for your personal use only. You must not divulge the password to any other person, and you should take reasonable precautions to ensure that it is not discovered by other people.
4. Data stored on our servers is not guaranteed to be backed up. It is recommended that you keep an independent backup of all data stored on your web space.
5. You may not run server processes (eg. talkers/IRC Bots) from your web space.
6. We shall not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.
7. When your account is closed, all files (including web pages, etc.) will be deleted.
8. We reserve the right to cancel your account at any time without notice.
9. We reserve the right to amend and update these Terms and Conditions at any time without notice.
10. To protect your privacy we never distribute your name or e-mail address to any third parties.
11. Users must not participate in any form of unsolicited bulk e-mailing or spam.
12. By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.
13. Halare.co.uk operates a fair use policy and therefore where it offers unrestricted use of bandwidth, should your bandwidth reach the points where it has an adverse affect on other clients we reserve the right to disable your site until you can reduce your bandwidth usage. 14. Web hosting accounts include a certain amount of data transfer, if you exceed this amount in any one month your account will be deactivated until you have upgraded to an account that has more data transfer included.
15. Web hosting accounts that host file distribution (including but not limited to music, video and software) are limited to a maximum data transfer of 25 GB per month for file distribution.
16. Web hosting accounts are prohibited from hosting adult content orientated web-sites, hosting banners, graphics or CGI scripts for other web-sites, storing pages, files or data as a repository for other web-sites or personal computers, giving away web space under a domain, sub domain or directory.
17. Should your account use more than 5% of the servers processing power and as a result have a detrimental effect on other customers we will discuss with you alternative solutions for your hosting requirements.
18. Commercial use of web and ftp space is permitted.
19. You will be responsible for the content of your pages, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate UK law.
20. You will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via your page(s).
21. We reserve the right to remove material deemed inappropriate from your web pages, without prior notice. Halare.co.uk do not allow adult, Warez or illegal MP3 web sites on their servers.
22. Unlimited web space is available for genuine web site content, content must be linked into web pages. Customers are prohibited from using the server as a file/backup repository. Customers are expected to employ good house keeping when maintaining their account.
23. If you take out one of yearly packages we expect you to commit for this period of time. Because of your commitment, we offer a discount on the normal monthly price of our accounts. If you cancel your account within your service period then Halare.co.uk will not make any refunds on any unused portions of your account. While we do not offer refunds for pro-rated service (beyond our 30 day money back guarantee which is applicable to annual accounts only) you have no obligation to continue using our service.
24. Our 14 day money back guarantee (applicable to annual accounts only) excludes the refund of domain name registration fees, secure server certificate purchases.
25. Halare.co.uk reserves the right to cancel the service at any time. Customer refund requests are to be sent to accounts@Halare.co.uk and will only be processed in the cases of service non-performance where Halare.co.uk is clearly at fault. Refund requests for problems beyond Halare.co.uk's control will be refused.
For example:
- Domain transfer failure.
- Failure of any third party script or program that's not supported by Halare.co.uk.
- A customer's lack of experience in dealing with web basics and communication protocols.
Customer agrees that it shall defend, indemnify, save and hold Halare.co.uk harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors fees asserted against Halare.co.uk, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Halare.co.uk against liabilities arising out of:
- any injury to person or property caused by any products sold or otherwise distributed in connection with Halare.co.uk's server.
- any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
- copyright infringement.
- any defective products sold to customer from Halare.co.uk's server.
Halare.co.uk will not be responsible for any damages your business may suffer, Halare.co.uk makes no warranties of any kind, expressed or implied for services we provide. Halare.co.uk disclaims any warranter merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by Halare.co.uk and its employees.
Halare.co.uk reserves the right to revise the above terms and conditions at any time.
1. IMPORTANT INFORMATION
You should carefully read the following terms and conditions. Your purchase or use of our products implies that you have read and accepted these terms and conditions.
2. LICENSE Our web-site grants you a nonexclusive limited license to use the web templates and other products sold through our web site by independent content providers (the "products") in accordance with these Terms and Conditions (the "license") issued by our company.
a) LIMITED USAGE GRANTED You may only use each individual product on a single web-site, belonging to either you or your client. You have to purchase same template once more in order to make another project with the same design
b) MODIFICATIONS You are authorized to make any necessary modification(s) to our products to fit your purposes.
c) UNAUTHORIZED USE You may not place any of our products, modified or unmodified, on a diskette, CD, web-site or any other medium and offer them for redistribution or resale of any kind without prior written consent from our company.
d) ASSIGNABILITY You may not sub-license, assign, or transfer this license to anyone else without prior written consent from templatemonster.com.
e) OWNERSHIP You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of independent content providers.
Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.
3. OUR REFUND POLICY Since our company is offering non-tangible irrevocable goods we do not issue refunds after the product is shipped, which you are responsible for understanding upon purchasing any article at our site. Please make sure that you've carefully read 'sources available' section. We only make exceptions with this rule when the product appears to be not-as-described on a case by case basis in agreement of the parties concerned. The deadline for any refund claim is one week after the delivery date
4. ANTIFRAUD CHECK Customer purchase can be suspended for manual antifraud check for 10-20 minutes as well as it can be suspended for longer term (around 20 hours) for more serious investigation. Antifraud check occurs because of growing number of fraud transactions from persons who are not actual cardholders of the credit cards used during purchase.
Our company reserves the right to change or modify these terms with no prior notice.
